These Terms and Conditions (“Agreement”) govern your access to and use of PracticeMarketer.com and its affiliated services (“Practice Marketer,” “we,” “us,” or “our”). By accessing our website, engaging our services, or opting into communications, you agree to be bound by this Agreement and our Privacy Policy.


1. Acceptance of Terms

By using our services, submitting your information, or opting in to communications, you acknowledge and agree to these Terms and Conditions and our Privacy Policy. If you do not agree, you should not use our services.


2. Services Provided

Practice Marketer provides marketing, technology, and communication services for healthcare practices, including but not limited to website development, hosting, content services, CRM tools, analytics, and communication platforms (collectively, the “Services”).


3. Text Messaging (SMS/MMS) Terms & Consent

a. Consent to Receive Messages

By providing your mobile phone number and opting in—whether through a website form, intake form, written agreement, verbal consent, or other affirmative action—you expressly consent to receive SMS and/or MMS messages from Practice Marketer.

Messages may include, but are not limited to:

  • Account-related notifications

  • Service updates

  • Appointment coordination

  • Marketing or educational messages

  • Support communications

Message frequency may vary.

b. Automated Messaging Disclosure

Some messages may be sent using automated technology or an automatic telephone dialing system (ATDS).

c. Carrier & Cost Disclosure

Message and data rates may apply depending on your mobile carrier and plan. Practice Marketer is not responsible for carrier charges.

Opt-Out Instructions

You may opt out of receiving text messages at any time by replying STOP to any message. After opting out, you will receive one final confirmation message. No further messages will be sent unless you re-opt in.

Consent to receive SMS messages is not a condition of purchasing any product or service.


4. Permitted Use & Messaging Compliance

You agree not to use Practice Marketer’s messaging tools to send:

  • Unlawful, misleading, or deceptive content

  • Spam or unsolicited messages

  • Content violating TCPA, CAN-SPAM, CTIA guidelines, or carrier policies

  • Content related to prohibited industries under carrier rules

Practice Marketer reserves the right to suspend or terminate messaging access for violations.


5. User Accounts

You are responsible for safeguarding your login credentials and for all activity under your account. You agree to provide accurate, current information and to update it as necessary.


6. Intellectual Property

All content, software, trademarks, and materials provided by Practice Marketer are owned or licensed by us and protected under applicable intellectual property laws. Unauthorized use is prohibited.


7. Third-Party Services

Our Services may integrate with third-party platforms (including SMS carriers and communication providers). Practice Marketer is not responsible for outages, delays, filtering, or actions taken by third-party providers.


8. Termination

We may suspend or terminate your access to Services at our discretion if you violate this Agreement or applicable laws. Fees paid are non-refundable unless otherwise stated in a written agreement.


9. Privacy

Your use of our Services is subject to our Privacy Policy, which explains how we collect, use, and protect your information, including mobile numbers used for SMS communications.


10. Limitation of Liability

To the maximum extent permitted by law, Practice Marketer shall not be liable for indirect, incidental, consequential, or special damages arising from use of our Services, including messaging delays, delivery failures, or carrier filtering.


11. Modifications to Terms

We may update these Terms from time to time. Updates will be posted on our website with a revised “Last Updated” date. Continued use of our Services constitutes acceptance of the revised terms.
